1. Eligibility

TravelPriceCheck does not sell, provide, or control travel services or products such as flights, hotels, or rental cars ("Travel Products"), except where expressly stated. These are offered by third-party providers ("Travel Providers"). Your interactions with any Travel Provider are governed by their terms and conditions.

We are not responsible for:

• The accuracy or fulfillment of any booking made through a Travel Provider.
• Cancellations, delays, changes, or fees imposed by Travel Providers.
• The conduct or performance of any third party.

It is your responsibility to understand and comply with Travel Providers' terms and policies.

3. Service Authorization

By using the Services, you expressly authorize TravelPriceCheck to:

• Access, monitor, and modify your travel reservations.
• Interface with Travel Providers on your behalf.
• Store and use your travel credentials.
• Process rebookings, cancellations, or compensation requests.
• If you opt in, access travel-related emails from your inbox to identify relevant reservations.
• Agree to Travel Provider terms and policies on your behalf.

This authorization applies to all current and future reservations you share with us.

4. Your Responsibilities

You agree to:

• Provide accurate and complete reservation and contact information.
• Maintain valid payment methods.
• Review any changes or notifications made through our Services.
• Comply with all applicable laws and Travel Provider rules.
• Maintain the security of your login credentials and notify us of any unauthorized use.

We reserve the right to suspend or terminate access to the Services at any time, with or without cause.

5. Use of the Site and Content

All content available through the Services, including text, software, graphics, logos, and images ("Content") is the property of TravelPriceCheck or its partners, and protected under intellectual property laws.

You may not:

• Copy, reproduce, republish, modify, sell, or distribute the Content.
• Use automated systems to scrape, extract, or mine data from the Site.
• Attempt to reverse-engineer any part of the Services.
• Use the Services for unlawful, deceptive, or misleading purposes.

6. Communications

By using our Services, you consent to receiving communications from us via email, text message, or third-party platforms (e.g., WhatsApp) related to your bookings, account activity, and marketing materials. You may opt out of marketing communications at any time by following the unsubscribe instructions provided.

7. Fees and Payment

Our service fees, if applicable, will be displayed during your use of the Services and are subject to change at any time. Unless explicitly stated, all fees are non-refundable.

You authorize TravelPriceCheck to:

• Charge any payment method you provide.
• Collect fees directly or through Travel Provider compensation.
• Store your payment information securely.

8. Disclaimer of Warranties

THE SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TRAVELPRICECHECK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• AVAILABILITY OF LOWER PRICES;
• REBOOKING SUCCESS;
• ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT;
• THE CONDUCT OR POLICIES OF ANY TRAVEL PROVIDER.

You use the Services at your own risk. We do not guarantee uninterrupted or error-free functionality.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRAVELPRICECHECK, ITS AFFILIATES, OR ITS EMPLOYEES, OFFICERS, OR AGENTS BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
• LOST PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA;
• ISSUES ARISING FROM THIRD-PARTY PROVIDERS, DELAYS, CANCELLATIONS, OR TECHNICAL FAILURES.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE THAT GAVE RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless TravelPriceCheck and its affiliates from any claims, losses, damages, liabilities, and expenses arising out of your:

• Breach of this Agreement,
• Use of the Services,
• Violation of any law or third-party rights.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason. Upon termination, your rights to use the Services will immediately cease.

The following sections will survive termination: 5, 6, 8, 9, 10, 12, and 13.

12. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the State of [Insert State], without regard to its conflict of law principles.

Binding Arbitration

All disputes arising out of or relating to this Agreement or your use of the Services shall be resolved exclusively and individually through final and binding arbitration, in accordance with the rules of the American Arbitration Association (AAA), and not in court.

13. Miscellaneous

• Entire Agreement: This Agreement constitutes the entire agreement between you and TravelPriceCheck.
• Severability: If any provision is deemed invalid, the remainder remains in effect.
• Waiver: Our failure to enforce any provision shall not be a waiver of that provision.
• Assignment: You may not assign this Agreement without our written consent.
